Introduction

Losing a loved one is one of life's most difficult experiences. In the midst of grief, you are suddenly faced with a long list of administrative, legal, and financial tasks that must be completed — many within strict deadlines. This checklist is designed to guide you through every step, in chronological order, so that nothing is missed.

Hong Kong's systems for death registration, funeral arrangements, and estate administration involve multiple government departments, each with its own forms, fees, and timelines. This guide consolidates everything into a single, actionable reference.

How to Use This Guide: Work through the checklist in order. Not every item will apply to every situation — for example, public housing notification only applies if the deceased lived in a Housing Authority flat. Skip items that are not relevant, but do not skip entire time periods without reviewing them.

Immediately (Day 1-3)

These tasks must be addressed in the first few days after the death. The priority is to manage the immediate medical, legal, and family situation.

1. Obtain the Medical Certificate of Cause of Death (Form 18)

If the death occurred in a hospital, the attending doctor will issue the Medical Certificate of Cause of Death (commonly called "Form 18" or "death certificate from the hospital"). This is NOT the official death certificate — it is the medical document that allows death registration.

If the death occurred at home or in a care facility, a registered medical practitioner who attended the deceased during their last illness must issue the certificate. If no doctor attended the deceased, or if the death was sudden or unexplained, the police and coroner become involved (see item 2 below).

2. Call the Police If Death Is Sudden, Unexplained, or Unattended

If the death was not attended by a doctor, was sudden or unexpected, occurred due to an accident, violence, or suspicious circumstances, or if the deceased had not seen a doctor in the 14 days before death, you must call the police immediately.

The police will attend the scene and a Coroner's investigation may be initiated. The body will be taken to the public mortuary at the Forensic Pathology Service of the Department of Health for a post-mortem examination.

3. Contact a Funeral Director

A licensed funeral director will help coordinate the funeral, cremation or burial, and the transport of the body. They can also assist with death registration paperwork. Hong Kong has both private funeral companies and non-profit services.

If cost is a concern, the Social Welfare Department operates a funeral grant scheme and can provide referrals. The Board of Management of the Chinese Permanent Cemeteries also offers assistance for eligible applicants.

Funeral directors can be found through:

  • Food and Environmental Hygiene Department (FEHD) licensed undertaker list
  • Hospital social workers (they typically have lists of funeral directors)
  • Religious organisations affiliated with the deceased
4. Notify Close Family Members and Friends

Inform immediate family, close relatives, and close friends. If the deceased had a religious community, inform the relevant clergy or community leaders who may assist with funeral rites and support.

Within 14 Days

The most time-sensitive legal deadline in the first two weeks is death registration, which must be completed within 24 hours of the death if practicable, and in any event as soon as possible. In practice, registration within a few days is common.

5. Register the Death at the Births and Deaths Registry

The death must be registered with the Births and Deaths General Register Office. Registration can be done at either of the two offices:

  • Hong Kong Island: Low Block, Queensway Government Offices, 66 Queensway, Hong Kong (Tel: 2867 2784)
  • Kowloon: 4/F, South Tower, West Kowloon Law Courts Building, 501 Tung Chau West Street, Cheung Sha Wan (Tel: 2150 8747)

Who can register: A relative of the deceased present at the death or during the last illness; any person present at the death; the occupier of the premises where the death occurred; or any person causing the disposal of the body.

Documents needed:

  • Medical Certificate of Cause of Death (Form 18)
  • Deceased's HKID card
  • Informant's HKID card

Fee: Registration is free. The Registrar will issue a Certificate of Registration of Death (Form 12) at no charge.

6. Obtain Certified Copies of the Death Certificate

You will need certified copies of the death certificate for banks, insurers, the Probate Registry, government departments, and overseas institutions. Each certified copy costs HK$140.

Recommendation: Order at least 6 certified copies at the time of registration. If the deceased had overseas assets, order 10 or more. You can order additional copies later, but it's more convenient to do it at registration.

Copies can be ordered from the same Births and Deaths Registry offices listed above.

7. Return the Deceased's HKID Card to Immigration

Under the Registration of Persons Ordinance (Cap. 177), the HKID card of a deceased person must be returned to the Commissioner of Registration within 30 days of the death. In practice, you can do this at the death registration or deliver it to:

You may keep a photocopy for your records before returning the original, as the HKID number will be needed for many future administrative tasks.

Within 1 Month

This period covers funeral arrangements, locating the will, and beginning the process of notifying institutions.

8. Arrange Funeral and Cremation/Burial

Hong Kong has limited cemetery space, and the vast majority of deceased persons (over 90%) are cremated. Key points:

Cremation:

  • Government crematoria are managed by the Food and Environmental Hygiene Department (FEHD)
  • Booking: FEHD cremation booking hotline — 2656 7271 or online at www.fehd.gov.hk
  • Cremation can typically be arranged within 7-15 days of the death
  • Government cremation fee: HK$0 (free for HK residents at government crematoria)
  • Niche (columbarium) placement: Apply through FEHD for government niches, or use private providers

Burial:

  • Public cemeteries: Very limited availability — only 6-year renewable plots are available at public cemeteries
  • Private cemeteries: Permanent or long-term plots available (e.g., Cape Collinson, Pok Fu Lam, etc.)
  • Application for burial permit: Through FEHD

9. Locate the Will

Finding whether the deceased left a will is critical, as it determines who administers the estate and how assets are distributed. Search the following locations:

  • At home: Check filing cabinets, drawers, safes, among personal papers
  • With their solicitor: Contact any solicitor the deceased used — they may hold the original will or know of its existence
  • Wills Registry: The Sub-Registry of the High Court maintains a Wills Registry where wills can be deposited for safekeeping. Search by applying at the Probate Registry, 38 Queensway, Hong Kong (Tel: 2840 1683). Fee: HK$30 for a search.
  • Safe deposit box: The will may be in a bank safe deposit box (see item 22 below)
  • With the deceased's accountant or financial adviser
Important: If a will exists, the named executor has the right and duty to administer the estate and must apply for a Grant of Probate. If there is no will (intestacy), the closest eligible relative must apply for Letters of Administration. The priority order is: spouse, children, parents, siblings, in that order.
10. Notify Banks (Accounts Will Be Frozen)

Visit each bank where the deceased held accounts, in person, with the death certificate and your own HKID. The bank will freeze all sole-name accounts and begin the bereavement process. Request a written confirmation of all account balances as at the date of death.

11. Notify the Deceased's Employer (If Applicable)

If the deceased was employed at the time of death, notify their employer promptly. Enquire about:

  • Outstanding salary, commissions, or bonuses payable
  • Group life insurance or death-in-service benefits
  • Employer-sponsored MPF contributions
  • Any outstanding leave pay or long-service payments
  • Return of company property (laptop, phone, access cards)
12. Notify the Landlord (If Renting)

If the deceased was the sole tenant, the tenancy agreement typically terminates upon death (though the estate remains liable for rent until the landlord is notified and the property is vacated). If the deceased was a joint tenant or had dependants living in the property, the situation is more complex.

Review the tenancy agreement for any specific clauses regarding death. Give formal written notice to the landlord.

13. Notify the Housing Authority (If Public Housing)

If the deceased was the tenant (main applicant) of a public rental housing (PRH) flat, notify the Housing Authority immediately. A surviving family member listed on the tenancy may apply to succeed the tenancy by submitting a "Transfer of Tenancy" application.

Important: If the deceased was the sole occupant, the flat must be surrendered. If there are remaining household members not on the tenancy, they must apply for addition within a specified period or face eviction.

14. Cancel Utilities, Subscriptions, and Memberships

To avoid ongoing charges to the estate:

  • Electricity: CLP Power (2678 2678) or HK Electric (2887 3411) — arrange final reading and close account
  • Gas: Towngas (2880 6988) — close account
  • Water: Water Supplies Department (2824 5000)
  • Telephone/Internet: Contact the relevant provider (HKT/PCCW, CMHK, 3HK, SmarTone, etc.)
  • Mobile phone: Cancel or transfer the contract. The phone number may be transferred to a family member.
  • Subscriptions: Cancel streaming services, newspapers, magazines, club memberships, gym memberships
  • Credit cards: Notify issuing banks (balances become estate liabilities)
15. Redirect Mail

Apply to Hongkong Post for mail redirection from the deceased's address to your own. This ensures you receive important correspondence (bank statements, government notices, bills) that may reveal unknown assets or liabilities.

Within 3 Months

This phase focuses on professional legal engagement, systematic asset searching, and preparing the probate application.

16. Engage a Solicitor for Probate (If Needed)

While it is legally possible to apply for probate without a solicitor (as a "personal applicant"), it is advisable to engage one for anything other than the simplest estates. A solicitor will:

  • Advise on the type of application needed (Probate vs Letters of Administration)
  • Prepare all court documents
  • Handle court requisitions (the court's follow-up questions)
  • Draft the Schedule of Assets and Liabilities

Typical fees: HK$20,000-80,000+ depending on estate complexity. Some solicitors offer fixed-fee packages for straightforward estates.

17. Begin Systematic Asset Search (Or Hire AssetCadet)

Do not assume you know all of the deceased's assets. A thorough search should cover:

18. Notify Insurance Companies

Search for all life insurance, accidental death, critical illness, and general insurance policies. Check:

  • Physical policy documents at home
  • Regular premium deductions from bank accounts
  • Correspondence from insurance companies
  • The Insurance Authority does NOT maintain a central policy search, so you must contact each insurer individually

Major insurers in Hong Kong: AIA, Manulife, Prudential, Sun Life, HSBC Life, FWD, AXA, China Life, BOC Life, Zurich.

File a death claim as soon as possible. Most policies require notification within a specified period (commonly 30-90 days). Death benefit proceeds payable to a named beneficiary are typically not part of the probate estate.

19. Notify MPFA / MPF Trustees

The deceased's Mandatory Provident Fund (MPF) accrued benefits must be claimed by the personal representative of the estate (i.e., the executor or administrator). Steps:

  • Identify the MPF trustee(s): Check payslips, employer records, or the MPFA's ePA (electronic Personal Account) system
  • Contact each MPF trustee to notify them of the death and request a balance statement
  • Claim forms: Each trustee has its own claim process — generally requiring the death certificate and Grant of Probate/Letters of Administration

20. Search the Land Registry for Properties

The Land Registry maintains records of all property ownership in Hong Kong. You can search by the deceased's name to find any properties registered in their name.

  • How: Apply for a "land search against a name" (also called a "person search") at the Land Registry
  • Where: Land Registry, 28/F, Queensway Government Offices, 66 Queensway, Hong Kong
  • Fee: HK$25 per name search (online via IRIS — Integrated Registration Information System)

21. Search the Companies Registry for Business Interests

If the deceased may have been a director or shareholder of any Hong Kong company, search the Companies Registry.

  • How: Use the Companies Registry's online ICRIS (Integrated Companies Registry Information System) to search by director/secretary name
  • Where: 14/F, High Block, Queensway Government Offices, 66 Queensway, Hong Kong

If the deceased held shares in private companies, the company's articles of association will govern how shares are transferred upon death.

22. Apply for Safe Deposit Box Inspection (Home Affairs Department)

If the deceased rented a safe deposit box at a bank, you cannot simply open it — even with a death certificate. A formal inspection process is required:

  • Apply to: Estate Beneficiaries Support Unit (EBSU), Home Affairs Department, 3/F Southorn Centre, 130 Hennessy Road, Wan Chai
  • Tel: 2835 1535
  • Process: Apply for a Certificate for Necessity of Inspection. An inspection will be conducted in the presence of government officers, bank staff, and the applicant. A detailed inventory is prepared.
  • Removal of contents: Requires a separate authorisation, which is only granted after the Grant of Probate/Letters of Administration is obtained
23. Prepare the Schedule of Assets and Liabilities

This is one of the most important documents for the probate application. It must list every asset and every liability of the deceased as at the date of death, including:

Assets:

  • Bank account balances (all banks)
  • Property (with market valuations)
  • Stocks, bonds, and other investments
  • Insurance policy values
  • MPF balances
  • Motor vehicles
  • Valuable personal property (jewellery, art, etc.)
  • Money owed to the deceased
  • Overseas assets (listed separately by jurisdiction)

Liabilities:

  • Outstanding mortgage balances
  • Credit card debts
  • Personal loans
  • Tax obligations (salaries tax, property tax)
  • Funeral expenses
  • Any other debts
Critical: The Schedule must be as complete and accurate as possible. Filing an incomplete or inaccurate Schedule can result in court requisitions (delays), amended filings, or in serious cases, personal liability for the executor/administrator. This is why a thorough asset search is essential before filing.

Within 6 Months

By this stage, you should have a comprehensive picture of the estate and be ready to file the probate application.

24. File the Probate Application at the High Court

The application for a Grant of Probate (if there is a will) or Letters of Administration (if there is no will) is filed at the Probate Registry of the High Court of Hong Kong.

  • Where: Probate Registry, LG/F, High Court Building, 38 Queensway, Hong Kong

  • Key documents: Petition, affidavit of the applicant, original will (if any), death certificate, Schedule of Assets and Liabilities, administration bond (for intestate estates), renunciation forms from other entitled persons (if applicable)
  • Filing fee: Proportional to estate value — HK$5 per HK$1,000 of estate value (minimum HK$265)
  • Personal applicants: If applying without a solicitor, the Probate Registry offers guidance and has staff to assist
25. Respond to Court Requisitions

After filing, the Probate Registry will review your application. It is common for the Registry to issue requisitions — written requests for additional information, corrections, or clarifications. Typical requisitions include:

  • Requests for additional evidence of the deceased's domicile
  • Queries about missing beneficiaries
  • Requests to amend the Schedule of Assets
  • Questions about the validity of the will

Respond to requisitions promptly to avoid delays. Each round of requisitions typically adds 2-6 weeks to the timeline.

26. Advertise for Creditors (Gazette and Newspaper)

To protect yourself as executor/administrator from personal liability for unknown debts, you should publish a notice in:

  • The Government Gazette: Apply through the Government Logistics Department (2537 5789)
  • A Hong Kong newspaper: Typically the South China Morning Post (English) and a Chinese-language newspaper

The notice gives creditors a deadline (typically 2 months) to submit claims against the estate. After this period, you can distribute the estate without liability for claims you did not know about.

After the Grant Is Issued

Once the High Court issues the Grant of Probate or Letters of Administration, you have the legal authority to act on behalf of the estate. The final phase involves collecting assets, paying debts, and distributing the estate.

27. Present the Grant to All Institutions

Obtain certified true copies of the Grant from the Probate Registry (you will need one for each bank and institution). Visit each bank, insurer, MPF trustee, and other institution holding the deceased's assets and present the Grant along with the Schedule of Assets.

28. Collect All Assets

Each institution will process the release of assets — typically into an estate account that you open in your capacity as executor/administrator. This process takes 1-4 weeks per institution. Asset collection includes:

  • Bank account closures and fund transfers
  • Insurance death benefit claims
  • MPF withdrawal
  • Securities liquidation or transfer
  • Property title transfer (at the Land Registry)
  • Safe deposit box content removal
29. Pay All Debts and Liabilities

Before distributing to beneficiaries, you must settle all of the deceased's debts from the estate funds. These include:

  • Funeral and testamentary expenses (first priority)
  • Outstanding taxes (salaries tax, property tax — contact the Inland Revenue Department: 187 8022)
  • Secured debts (mortgages)
  • Unsecured debts (credit cards, personal loans)
  • Solicitor and professional fees for estate administration
30. Wait 2 Months After Creditor Advertisement

If you published a notice for creditors (item 26), wait until the 2-month notice period expires before distributing the estate. This protects you from personal liability for unknown claims that were not submitted within the notice period.

31. Distribute the Estate to Beneficiaries

Once all debts are paid and the creditor notice period has expired, distribute the remaining estate according to:

  • If there is a will: According to the terms of the will
  • If there is no will (intestacy): According to the Intestates' Estates Ordinance (Cap. 73):

Prepare a distribution account showing all assets collected, debts paid, and the final distribution to each beneficiary. Have each beneficiary sign a receipt.

32. Keep Records for 6 Years

Retain all estate administration records for a minimum of 6 years after the final distribution. This includes:

  • The Grant of Probate / Letters of Administration
  • All bank correspondence and balance confirmations
  • The Schedule of Assets and Liabilities
  • The distribution account
  • Beneficiary receipts
  • All invoices and receipts for estate expenses
  • Tax filings and clearance letters

3. 聯絡殯儀服務公司

持牌殯儀服務商會協助安排殯葬、火葬或土葬事宜及遺體運送。如有經濟困難,社會福利署設有殮葬費津貼計劃。

4. 通知至親及好友

通知直系家屬、近親及好友。如先人有宗教社區,通知相關神職人員。

14天內

5. 到生死登記處辦理死亡登記

死亡登記可在以下任一辦事處辦理:

  • 港島:金鐘道66號金鐘道政府合署低座(電話:2867 2784)
  • 九龍:長沙灣東京街西501號西九龍法院大樓南座4樓(電話:2150 8747)

費用:登記免費。登記處會免費簽發死亡登記證明書(表格12)。

6. 取得死亡證明書經認證副本

每份經認證副本費用為HK$140。建議在登記時取得至少6份。如先人有海外資產,建議取得10份或以上。

7. 將先人的身份證交回入境事務處

根據《人事登記條例》,先人的身份證須在去世後30天內交回人事登記處。建議先影印副本留檔。

8. 安排殯葬及火葬/土葬

香港逾90%先人選擇火葬。政府火葬場由食物環境衞生署(食環署)管理。

  • 骨灰龕位:可向食環署申請政府龕位或使用私營設施
9. 尋找遺囑

搜尋地點包括:家中文件、先人的律師、高等法院遺囑登記處(遺產承辦處,金鐘道38號,電話:2840 1683,搜尋費HK$30)、銀行保管箱。

重要:如有遺囑,遺囑指定的遺囑執行人有權利和責任管理遺產,須申請遺囑認證書。如無遺囑(無遺囑繼承),最親近的合資格親屬須申請遺產管理書。優先次序為:配偶、子女、父母、兄弟姊妹。
10. 通知銀行(帳戶將被凍結)

帶同死亡證明書和您的身份證親自到各銀行通知。銀行會凍結所有個人名義帳戶。索取截至死亡日期的帳戶結餘確認書。

11. 通知先人僱主(如適用)

查詢:未發薪金、團體人壽保險或在職死亡福利、僱主MPF供款、未放年假薪酬、歸還公司財物。

12. 通知業主(如先人為租客)

如先人為唯一租客,租約通常於死亡時終止(但遺產仍須繳付租金直至業主收到通知及交回單位)。以書面方式正式通知業主。

13. 通知房屋委員會(如為公屋租戶)

如先人為公屋租約戶主,須立即通知房屋委員會。列於租約的在生家庭成員可申請「租約轉名」。

17. 開始系統性資產搜尋(或聘用AssetCadet)

不要假設您了解先人的所有資產。全面搜尋應涵蓋:所有主要銀行、保險公司、強積金受託人、證券經紀商、土地註冊處、公司註冊處、海外資產及數碼資產。

18. 通知保險公司

搜尋所有人壽保險、意外死亡保險、危疾保險和一般保險保單。查看家中保單文件、銀行帳戶的定期扣款記錄、保險公司信件。

香港主要保險公司:友邦、宏利、保誠、永明、匯豐人壽、富衛、安盛、中國人壽、中銀人壽、蘇黎世。

19. 通知積金局 / 強積金受託人

先人的強積金累算權益須由遺產代表(遺囑執行人或遺產管理人)申索。

20. 到土地註冊處查冊

通過「人名查冊」查找先人名下的物業。

21. 到公司註冊處查冊

通過「公司註冊處綜合資訊系統」(ICRIS) 搜尋先人是否為任何香港公司的董事或股東。

22. 申請保管箱檢視(民政事務處)

如先人在銀行租有保管箱,須向民政事務處遺產受益人支援組申請「檢視必要證明書」。

  • 程序:由政府人員、銀行職員及申請人在場下檢視並編製詳細清單。取出物品須另行申請授權,待取得承辦書後方可批准。
23. 編製資產負債表

資產負債表是遺產承辦申請中最重要的文件之一,必須列出先人在死亡日期時的所有資產和所有負債

關鍵:資產負債表必須盡可能完整和準確。提交不完整或不準確的資產負債表可能導致法院提出質詢(延遲)、修改申報,或在嚴重情況下導致遺囑執行人/遺產管理人承擔個人責任。因此在申報前進行全面資產搜尋至關重要。

6個月內

24. 向高等法院提交遺產承辦申請

向高等法院遺產承辦處申請遺囑認證書(有遺囑)或遺產管理書(無遺囑)。

25. 回應法院質詢

提交申請後,遺產承辦處會審閱並可能發出質詢 — 要求提供額外資料、更正或澄清。及時回應質詢以避免延誤。每輪質詢通常增加2-6星期。

26. 刊登債權人公告(憲報及報章)

為保障自身免承擔未知債務的個人責任,應在以下刊物刊登公告:

  • 政府憲報:通過政府物流服務署申請(2537 5789),費用約HK$2,000-3,000
  • 香港報章:通常為英文報章(如《南華早報》)及中文報章

公告給予債權人2個月的期限提交申索。

承辦書頒發後

27. 向所有機構出示承辦書

從遺產承辦處取得承辦書的經認證副本,到各銀行、保險公司、強積金受託人及其他機構出示。

28. 收回所有資產

各機構處理資產發放通常需時1-4星期。包括:銀行帳戶結清及轉帳、保險死亡賠償、強積金提取、證券變現或轉移、物業業權轉讓、保管箱物品取出。

29. 清償所有債務

在分配遺產前,必須以遺產資金清償先人所有債務:殯葬及遺囑費用(優先)、未繳稅項(稅務局:187 8022)、按揭、信用卡、個人貸款、律師及專業費用。

30. 等待債權人公告期屆滿(2個月)

如已刊登債權人公告,須等待2個月公告期屆滿後方可分配遺產。這可保障您免承擔未在公告期內提出的未知債務。

31. 將遺產分配予受益人

清償所有債務並待債權人公告期屆滿後,按遺囑條款(有遺囑)或《無遺囑者遺產條例》(無遺囑)分配遺產。

在生家屬分配方式
僅配偶(無子女、父母或兄弟姊妹)配偶獲得全部遺產
配偶 + 子女配偶:個人物品 + 首HK$500,000 + 餘額一半。子女:另一半均分。
配偶 + 父母(無子女)配偶:個人物品 + 首HK$1,000,000 + 餘額一半。父母:另一半均分。
僅子女(無配偶)子女均分
僅父母父母均分
僅兄弟姊妹兄弟姊妹均分

編製分配帳目,列明所有已收回資產、已繳債務及最終分配予各受益人的金額。請各受益人簽署收據。

32. 保留記錄6年

在最終分配後保留所有遺產管理記錄至少6年,包括:承辦書、所有銀行信件及結餘確認、資產負債表、分配帳目、受益人收據、所有遺產費用的發票及收據、稅務申報及清稅通知。
